Picking at a Scab – The Blumer Report 1986

“I wonder if I can write this history or if on every page there will be some sneaking show of a bitterness I thought long dead. I think myself cured of all spite, but when I touch pen to paper, the hurt of a boy bleeds out with the sea-spawned ink until I suspect each carefully formed black letter scabs over some ancient scarlet wound.”

Robin Hobb – Assassin’s Apprentice.

Richard, post conviction, at a San Francisco hearing.

On January 19th and 20th, 1986, only a few months after Dr William Vicary had seen him, Dietrich Blumer, M.D., neuropsychiatrist, examined Richard Ramirez at trial counsel’s request and found he suffered from temporal lobe disorder.
What, another one? Yes, one more in a long line of psychiatrists coming to the same conclusion, pre-trial and post-conviction.
He reviewed Richard’s elementary and high school reports, TYC custody records, and medical history during his evaluation. He also interviewed three of Richard’s siblings.

Writ of Habeas Corpus – Declaration of Dietrich Blumer, doc 7-18

Dr Blumer found Richard “guarded and uncooperative” Blumer was probing him about his affiliation with Satanism and naturally found him closed regarding this; he did not want to be judged insane.
He seems particularly interested in the satanic aspect; this could be explained because of Richard’s famous in-court palm flashing of the pentagram on October 24th 1985, during a hearing to establish his change of lawyers. As a neuropsychiatrist, Dr Blumer possibly found that fascinating.

Declaration of Dietrich Blumer, doc 7-18

A man with years of experience and many published books and articles on temporal lobe epilepsy and related neurological conditions, Dr Blumer was well placed to give his recommendations; he had successfully treated many patients and opined that Richard’s condition was treatable with the proper medication. He indicated that Dr Henderson, who had seen Ramirez previously, “would know what needs to be done”.

Declaration of Dietrich Blumer – doc 7-18. Recommending a full evaluation in collaboration with Dr Victor Henderson. Richard was not found to be schizophrenic, unlike his cousin, Miguel.

“All of His Life”

“Dr Blumer has stated that Petitioner’s multiple impairments require ‘proper care and treatment for serious, lifelong neuropsychiatric deficits because [of] … debilitating effects of organic brain dysfunction.’ (Ex. 31, D. Blumer, M.D., dec., ¶ 15.) Dr Blumer’s findings establish that Petitioner is permanently afflicted; he will not recover or regain normal functioning. Treatable, in this instance, certainly does not mean curable. Petitioner has been ill for at least thirty-five years and probably all of his life.”

Writ of Habeas Corpus – page 687

The above statement is taken directly from the 2008 Writ of Habeas Corpus, twenty-two years after Dr Blumer’s original report on Richard was made. He was mentally ill, unable to assist in his defence or understand the proceedings against him, yet the world knows nothing of this. It’s been swept aside because labelling him (incorrectly) as a psychopath draws the crowds.

How can anyone watching the minimal court footage available to us honestly think he was “right”? It is beyond all imagining. What is being witnessed there is disassociation, an act, a character given to him by law enforcement, the court and the media. The image he portrayed, the psychopath known as the Night Stalker, had gone beyond Richard’s control, and, as he said, he would not “give them the satisfaction of seeing me down”. His guilt was already presumed, so he gave the media what they wanted.

Writ of Habeas Corpus page 166

Richard’s mental state during his arrest was exacerbated by involuntary withdrawal from drugs and being locked up in a cell so tiny that his defence team jokingly called it the “phone booth.” Only it wasn’t a joke. His paranoia made him unable to trust those around him, and his main concern was that he did not want to be considered insane. Only Richard could have fully answered why; we can only take a guess. Pride? Stigma? Or his fear of being committed to a psychiatric hospital.
His psychosis, left untreated, dictated how he reacted to the most stressful situation one can imagine, fuelled by paranoia and his instinct telling him that everyone was “out to get him”. In that, at least, he was correct.

Declaration of Dietrich Blumer – doc 7-18.

His judgement was severely compromised; he could no longer function rationally, was utterly debilitated, and could not discern who (if anyone) was acting in his best interests. No one was. His defence was working in their best interests, trying to fund a defence as the court refused to appoint them because they were not qualified to practise under the Californian Bar Plan. The case they had taken on thinking it was “indefensible” had been discovered to be defensible after all. Still, they didn’t have the experience, competence or money to enable them to rise to the task, which showed. Daniel and Arturo Hernandez did not develop an alternative defence strategy involving Richard’s mental health for reasons we have explained in previous posts concerning his defence counsel. They knew Richard was mentally unwell, but monetary concerns overrode any other action they could and should have taken.

Sealed document, recorded court transcript 29th September 1987

More information on his dodgy lawyers can be found HERE.
Writ of Habeas Corpus – page 207. Despite this information, the defence failed to challenge Richard’s competence to stand trial, in violation of his Sixth Amendment right to effective assistance of counsel.

Eleven

This is a list of the doctors and psychiatrists who all came to the same conclusions in the twenty years following Richard’s arrest. This doesn’t include the ones who saw him during the 1970s.

  • William Vicary
  • Dietrich Blumer
  • Victor Henderson
  • Elise Taylor
  • Anne Evans
  • George Woods
  • Myla Young
  • Marilyn Cornell
  • Robert Schneider
  • Dale Watson
  • Jane Wells

Eleven doctors discovered how incapacitated Richard was, and it’s about time we put to bed the myth that Ramirez was a “smart” criminal, a mastermind able to outfox and run rings around law enforcement until he met his match. There is nothing further from the truth. In the free world, he could function by self-medicating, existing on a cocktail of drugs as his life spiralled out of control. And although he seems to have been able to interact with those around him, a criminal mastermind, he was not.

It should be noted that out of these eleven, only three saw him before his trial began in 1989. The reason why has been given in previous posts, but I will remind you that it was his San Francisco lawyers who did the work that Los Angeles failed to complete.

“Trial counsel did not ask me to appear in court and testify about my findings and conclusions. I was not directed by trial counsel to evaluate the impact of Petitioner’s disorder upon his behaviour at the time of the alleged criminal acts and his arrest. Moreover, I was not consulted regarding the entry of a plea of not guilty by reason of insanity, Petitioner’s capacity to assist counsel at his capital trial, or Petitioner’s ability to waive his legal rights during trial, including his purported waiver of a penalty trial. If I had been asked to render an opinion regarding Petitioner’s conduct and mental capacity, I would have done so based on my findings set forth in this declaration”.

Declaration of Dietrich Blumer – doc 7-18

Declaration of Dietrich Blumer doc 7-18.

Richard was supposed to see Dr Blumer a third time, an appointment scheduled for April 14th 1986; he refused. Blumer stated that it was because of his fears that an insanity plea would be introduced. Perhaps another reason could be that Richard did not want to be subjected to a chromosomal study; Blumer had indicated that it might be a good idea because of his “exceptional height”. Richard was 6ft 1, very tall but not “exceptional”, surely?

The chromosomal study was never done, and the findings of Dietrich Blumer were not followed up, developed, or presented in court.

The report is dated the day Richard refused to see Dr Blumer, who was concerned about a possible suicide attempt.

Thanks to the Blumer report I finally understand Richards Performance in the court room and at his trial. Hopefully all experts and non experts stop labeling him as Psychopath or Sociopath.

      1. I ve just read this chapter once again , as I wanted to bring the findings and evaluation of Dr Blumer back to my memory , in a precise way. And , while reading about Richards fear of beeing considered as mentally insane by Dr.Blumer ( and most people around him ) , this almost brought me to tears again…Especially when I think about additionally making an examination of his Chromosomes ! This must have been such an awful frightening and degrading experience for him , all of those meetings with doctors etc. Thats beyond my imagination actually …I don t know how he managed to do all this ..I. admire his strength and resilience and if he was considered ” nuts” , I can understand why he could appear like that , under those circumstancances . He felt he could nt trust anyone .. thats actually normal , (haha ? 🙂 And of course its so scandalous , that Dr Blumer was Not heard by Richards defense council , concerning his really complex Mental Impairments – which he definitely had ! I feel its such a pity that they didn t do that. And its so clear that Richards biggest concern and fear was to be declared insane and be transferred to a hospital forever . I fully understand that he refused to see Dr Blumer again , even when Dr Blumer actually wanted to support him , which I like to believe.

  3. Yes .. I had to fight tears . Those proceedings should be more and better known to the public , to those ” Fans ” who adore or idealize him for the wrong reasons …They obviously have no idea about how his reality was like . The possible examination of his status of chromosomes made me feel bad and frightened .

    1. Sadly, they only want people to accept the given story. This has been hidden and not talked about.. until now.

  4. Do you happen to know why Dr Blumer thought about an examination of Richards chromosomes ? I know Dr Blumer referred to Richards height , as Richard was quite tall….but …sorry , I don t see the sense in this . What did Dr Blumer want to find out by doing such an examination ? This question appears in my head over and over again..So I thought I write a comment and ask . What does it mean when a person is tall , I don t see any connection to anything . Maybe there s nothing to it ..but still I m curious.

    1. I had the exact same question today, and it doesn’t make sense to me either. While Richard was tall, he wasn’t tall enough to warrant chromosome testing. I don’t doubt that he may have had some genetic abnormalities, considering that his mother, Mercedes, was exposed to toxic chemicals while pregnant with him—not to mention the potential aftereffects of atomic bomb testing in nearby New Mexico. However, the idea that he needed chromosome testing simply because he was 6’0″ or 6’1″ doesn’t add up. His parents were also fairly tall, so his height wasn’t particularly unusual. If he had been exceptionally tall, like Ed Kemper, who is around 6’7″ or more, then chromosome testing might have made more sense.

    2. Both he and Dale Watson suspected that Richard might have Marfan Syndrome, a genetic condition affecting the connective tissues in the body. People with the illness tend to be tall, slender and can have very long fingers and toes, as well as other symptoms.

  5. Yes , those examinations are just side effects of the whole processs of the investigation…and Richard didn t do this one anyway ..I was thinking about how stressful all this must have been…and that he had Doreen to talk to..hopefully.

  6. So good to know that here in the blog we can ask and discuss questions in a intelligent and emphatic way . Makes me feel good that Vivi had the same question as me. ( I was on You Tube expedition ) ..and I read about newcomers who claim Richard was a 100 % evil…They get really naughty when you try to say something against their devil theories ..That s not normal anymore … Help . It makes me question the whole society sometimes . But its just that dumbness !!

      1. Yes , that was the best idea ! I d like to know wether there is actually more about the Psych reports than you ve posted from Plain Site , as I don t remember , Ive started there 1 year ago when I didn t know about your blog.. I can find out myself though…And I have a question about a converation of Richard with Eric Holler ..In this Richard seems extremely enthusiastic and also very boyisch…and I wondered why that is . Its the conversation about a book which Holler obviously had given to Richard. And Richard says how much he liked it and that he made similiar experiences like the protagonist in the book , as ..doing some sort of crime..hearing the steps of a woman..He s following the woman etc. Why did he do that ..Holler provoked this somehow ..Richard did not know he was recorded ..but to me it feels as if Richard was boasting to impress Eric Holler .

      2. The Evans and Cornell reports are massive. The Cornell stuff I wrote about in the “Richard’s Background” section.
We covered a lot, both here and in the book, but go back to the petition and read them through. In our blog posts we quote the document numbers so you can find them. I don’t have my laptop on so can’t give you the exact document numbers, but we quote them in the posts.

As for Richard.. I can’t answer for him, sadly, and I am pretty sure I haven’t heard that one myself. The recording of his conversation proves he couldn’t trust anyone. Perhaps he wanted to please his “friend” and live up to his Night Stalker image, after all, wasn’t it Holler who sold his Night Stalker paintings for him? I think it was him, although I could be wrong.

  7. Thanks for the infos , I ll read about Evans etc.reports again..And ..this conversation . when was it , do you happen to know ? Richard did not know he was recorded , right ? Then .He must have said that to impress Holler I mean..it sounds as if Richard boasts with sth he has done. So crszzzy .But when you dont know the whole background you can assume what he says is a confession . But one way or another, nobody cared or nobody took it serious .? Obviously not .. and for what does it serve then …to even more confuse people ? Incredible ! What did you think about this when you didn t know that much about this case ? Or maybe its a sort of game in prison …But the ” fans” on YouTube take it very serious .. But . I understand that you cannot speak for Richard . I think he s just boasting . OMG ..this really is so crazy , unbelievable. Richard sounds very enlightened , even a high . Like a 15 year old too ..I would say its a prison crazyness maybe ..

    1. I don’t know when the conversation took place, I’m afraid, and I don’t even know if I’ve heard that one at all.

I’ve heard him sounding very young and excitable when talking to Eric about Doreen being on TV, that was around the time she did the promotions for Carlo’s book.

  8. Aha.Are there edits of Doreen promoting the Carlo book ? And ..where was this ? I don t know anything about that ! And was the book a sucess ? Richards conversation with Eric Holler .about Doreen in TV. , is it on tape ? It seems so . Sorry about repeaing myself about those tapes . I know all of us have wrote comments about that. Its annoying because the content is so contradictive. And because we won t get answers .

  9. Allright thanks . Interesting that Carlo s book was and is very sucessful . I ll watch the Peacock docu again to find the part with Doreen .I ve only seen that once because I had such an aversion against it . ..And I ll stop with the Carlo tapes ..as we done all that already …But I think in the recording its Eric Hollers voice not Carlo s voice …I think I knew how Carlo s voice sounded. Thanks again.

    1. I think you may be able to find Doreen’s interview on YouTube as well. As for Holler, I haven’t really listened to any of the conversations, apart from the one where Richard asks him if he knows who’s saying things about him on line.
