To Prove a Lover

This is an addition to the article covering the murder of Tsai-Lian Yu and I would refer you back to that original post for all the details on this case.  I am adding a little information we discovered during our visit to the Hall of Records in Los Angeles. Leafing through the first volume, we came across some information from the preliminary hearing that didn’t appear during the trial.
We found it interesting and worth sharing.

A Brief Re-Cap

The killing of Tsai-Lian was the only count commuted to the lesser charge of second-degree murder rather than first-degree; it could not be shown that her killing was done with intent and malice aforethought.  This is because of eyewitness testimonies; one described a “lovers’ quarrel”, and the other described a fight between the victim and the perpetrator.  

“Gallegos saw the man from the blue car lean into the window of the yellow car and try to pull the woman from her car. Gallegos thought they were having a lovers’ quarrel.”  (2008 Petition of Habeas Corpus, page 50)

The above is an embellishment on his original witness statement from Jorge Gallegos Calderon.  In the original statement, taken by Monterey Park Officer Dan Romero, Gallegos denied seeing a fight and said he would be unable to identify the suspect.

He later surprised the prosecution, defence and probably himself by suddenly and implausibly identifying Ramirez.
He was not the first (or last) eyewitness to change their story in court.
Joseph Dueñas, the second eyewitness, initially identified Ramirez at the 1986 preliminary hearing but later admitted he could not identify him and recanted his statement.
This is hardly surprising, as both had described a short-ish man of 5ft 7 to 5ft 8 with a possible Asian or Latino appearance. Ramirez was 6ft 1.


A Lovers’ Quarrel?

Engaging in a lovers’ quarrel implies a relationship with the opposite party, although there is no suggestion that Tsai-Lian Yu had any connection to Richard Ramirez, let alone that they were lovers.  Yet the possibility must remain that Tsai-Lian knew her killer if we are to believe the testimonies that Yu was holding on to her attacker as he told her, ” Get away from me!”.  

Tsai-Lian Yu did have a boyfriend, although nothing about him is known, not his name, height, or ethnicity. Was he also Asian? We don’t know.
Officer Anthony Romero of the Monterey Park Police (there were two Officers named Romero, Dan and Anthony) did the initial investigations before the case was taken over by Gil Carrillo and the task force.  Romero testified that Tsai-Lian had wanted to marry her boyfriend, but he did not want to marry her.

Apologies for the bad quality photo – we only had mobiles and had not yet been given permission to take pictures at the time this was taken, some stealth was needed.. Permission was received later.

For clarity I will transcribe below:

“ Officer Anthony Romero testified that this victim, Ms Yu, wanted to marry her boyfriend but he did not want to marry her.”  Taken from the recorded transcript from the preliminary hearing, dated 18th March 1986. 

This snippet was amongst the pile of case volumes and is something that we have never seen mentioned before.

For whatever reason, the boyfriend doesn’t seem to have been interviewed at all. Perhaps he was out of town, giving him a cast-iron alibi. Nonetheless, one would still expect that a boyfriend would have been questioned, especially as there was the suggestion of conflict between them. No, I am not saying that this unknown boyfriend killed Tsai-Lian, yet it is evident that the court was determined that the defence should not be allowed to raise the subject of Yu’s relationships with men.   

Halpin Objects

Richard’s defence suggested an ex-boyfriend might have been her killer, which was totally acceptable, given that they had heard two testimonies describing lovers’ arguments and fights in the street.  Halpin objected, saying that Yu’s boyfriends were “irrelevant”, which sounds ludicrous, as his own witnesses were the ones to mention lovers in the first place.
Judge Tynan sustained, and so Richard’s defence team were never allowed to question Yu’s friend, Jean Wang, about the conflict with the boyfriend or anything at all.  Her genuine and actual relationships were deemed to be null and void, banished into the ether as the case was brought under the umbrella of Carrillo’s ‘fear fetish’ theory.  A theory that falls at the third murder ascribed to the Night Stalker in 1985.

Joinders

The Yu incident was a non-capital homicide charge that was elevated to a death penalty one by the prosecution’s usage of joinders, whereby cases with more robust looking evidence were linked to those with weaker.

“In closing argument, the prosecution urged the jury to find Petitioner guilty of first degree murder in the Yu incident based on a theory of deliberate and premeditated killing with malice aforethought. In rebuttal argument, the prosecution stated that Petitioner’s denial of involvement in the Yu shooting abrogated the jury’s need to consider any of the manslaughter instructions. The jury returned a verdict of second-degree murder.” 2008 Petition of Habeas Corpus, page 626

At no stage did the prosecution attempt to prove a link between Tsai-Lian Yu and Richard Ramirez. The conviction rested on the tenuous coupling of a flawed ballistics report and unreliable eyewitnesses, both of whom should have been impeached.

“Gallegos admitted he told the investigating officers that he could not identify the man and that his description was quite different to the defendant’s actual appearance.”   Recorded transcript, preliminary hearing, 18th March 1986.

The visit to the Hall of Records and reading the case files corroborated what we had already said.  It also raised more questions that should have been answered nearly 40 years ago.

  1. Isn’t Jorge Gallegos Calderon the one who initially complained that his statement wasn’t accurately conveyed because he was interviewed in English? It’s interesting, though, because I remember is being mentioned that he was later interviewed in Spanish by another officer, allowing them to compare and verify his statements in both languages. I think the theory of him and Joseph Dueñas just wanting to be part of such a high profile case is the reason for their stories changing so much. Just fame hungry .

      1. I apologize I probably read that wrong. But he still can’t complain that he was not interviewed properly especially since the interview was conducted in his native language. The burden is on him as a eyewitness to convey all the information including mentioning that he saw the fight between Tsai-Lian and the killer if he saw it.

    3. Yes, Halpin tried to blame the Monterey Park police for misinterpreting his bad English but Detective Corrigan interviewed him in Spanish.
      Incidentally, Corrigan is the one who interviewed Sophie Dickman and wrote that the attacker was 5’8″…

  2. It’s frustrating that we know so little about Tsai-Lian’s relationships—a critical gap in understanding that seems both unfortunate and rather short-sighted. I find it especially interesting that she apparently wanted to marry, while her boyfriend showed reluctance. The fact that Officer Romero testified on this suggests that her relationship status held some importance, particularly given that witnesses suggested the crime might have stemmed from a romantic conflict. Judge Tynan’s decision to bar further questions into Tsai-Lian’s private life seems arbitrary, as this line of questioning would have been highly relevant. Investigating her relationships, especially to establish whether or not any quarrel might have occurred, would have provided much-needed context to the case. The inclusion of this crime in the joinder feels like an attempt to offload unresolved cases onto Ramirez. If I were a juror, I’d find it hard to conclude that this was a lovers’ quarrel without clear, corroborative evidence of a relationship between Tsai-Lian and Ramirez.

  3. sometimes it’s so hard to believe all this happened cuz of how crazy the whole case was and still is. Knowing that’s it’s true and this indeed happened makes me speechless. Why couldn’t anyone manage those witnesses properly

      1. Those guys will always find excuses to make Richard look guilty they just as bad as tynan and his gangs! Dw about them! I believe you guys and your honest research! It’s seriously is mind blowing! Cuz like as I was reading this post I was thinking I totally don’t believe at all Richard and her had any form of relationship, cuz Richard was not clean, homeless, drug addicted and I don’t think she would be with somebody like that let alone her family wouldn’t allow it maybe it is indeed an ex wanting her back and to leave her current boyfriend.

      3. They really should have investigated her current boyfriend and ex. I know Richard stated that Asian girls are his favourite but that doesn’t prove he did it just cuz she was Asian.

  4. Stunned that they didn’t at least try to trace the boyfriend. After all, it is always far more likely you will be killed by a BF/partner than a random serial killer.

    1. Yes, that’s very true. I can only think that the boyfriend must’ve had a strong alibi, although there is nothing to imply he was even questioned. There’s a blank where he’s concerned. An alibi still doesn’t excuse Halpin’s objection to the defence asking Tsai-Lian’s friend about him. To say “boyfriends are irrelevant” is absolutely crazy. Especially as there was a suggestion of conflict.
      So that objection was sustained whilst simultaneously allowing the suggestion of a “lover’s quarrel” to be seriously considered.
      If that’s the case, talk to the lovers, past and present.

  5. I ve read a lot about joinder and severence because of my curiousity and I found a PDF by University of North Carolina . They described it quite well and now I m wondering wether Richard was informed about this properly….probably not. ..Steve Strong was the expert of joinder ..and he was of the opinion that the crimes were not to be joined as they showed not enough similiarities , and some other Kriterien for joinder were also not fullfilled. One was the bad description of the victims about the looks of R.R. …and that tainted ballistics were not enought for using joinder also.I must read that again. I find this joinder prinzipiell not even so bad ! But yes , if they had severenced the cases it would have been better for Richard. Im now trying to figure out the dissimiliarities…or rather the not connecting things.Like the victims looked so different ..Dayle Okasaki was killed by a shot in her forehead . She looked very different to Maxine Zazzarra , we all know why…Jenny Vincow s wounds in her face , throat and upper body must have looked also very bad….So ..each victims look and also the weapons that were used must be examined…Also the way they were killed…Maybe they made a generalisation of the criteria , then it could be easier to find similiarities and combine the crimes.

      1. Yes ..I read what you ve written about spillover . Its all very interesting how they handle those things / problems .In the University PDF they show many examples when joinder is appropriate and when not. I find this interesting..They describe the 4 Kriteria thatmust be fullfilled vor applying joinder . And therefor I believe that joinder Was not 100 % akzeptable for Richards case . The spilllover thing is a quite dangerous side effect I guess .In general im concious that Richard must have been completely lost in all those tactical prozedures …And I m much more aware now that Richard did not have ” a lobby ” …I doubt that he was actuall taken serious..Most lawyers etc. saw him as a drug addicted uneducated ‘Mexo ” who did a series of hedonistic crimes and who m they want to get rid of . Richards Performance did make it more difficult at the courtroom .When I think about all this I get slightly annoyed and a little depressed …

  6. They removed sensitive items, but as they did it in a hurry, some were left behind. Yes, that included two mortuary photos of Dayle Okazaki and Tsai-Lian Yu, but we did not take photos of those. That is something we would never share or even want to keep for ourselves. We have never posted crime scene photos here.
    It is in a basement, with no windows and there are desks and security guards. It was a bit surreal. They knew we were writers/researchers of some sort but we didn’t give details.

      1. I’m a bit confused with the fact that I still don’t understand who was the one in charge of the whole case cuz Gil if I remember correctly was not supposed to be part of few crimes I think then he just I guess pushed his way in idk I might be wrong tho but I’m just lost on this part

      2. To begin with each individual case was investigated by it’s own police jurisdiction, so Yu fell within Monterey Park’s district. Only a couple of cases were within LASD’s area to begin with until eventually all were incorporated under the umbrella of the Night Stalker task force headed by Salerno and Carrillo.

      6. Ok I’m not from L.A. but this is what I know: there are 88 cities in Los Angeles County. 42 have no police department and come under the Los Angeles County Sheriff’s Department. Other cities have their own police departments but might call in the Sheriffs for assistance if they need specialist detectives, especially if it’s a low crime area.

        Monterey Park not only has its own PD, but they have their own homicide detectives and handle their own – unless the case crosses over with LASD areas. LASD are never called to Monterey Park crimes. However, they share the LASD’s crime laboratory and LASD crime scene technicians attend Monterey Park scenes. One was Linda Arthur which is how Carrillo was called into both the Doi and Dickman cases. Monterey Park didn’t want him there.

        Arcadia Police Department voluntarily gave two murders to the LASD, the first being Patty Higgins. Then because they insisted that Mary Cannon’s murder was connected, and there were rumours of a serial killer spreading through police agencies, Arcadia PD just allowed them to take over. Similarly, Glendale PD deal with their own murders but exhanged notes with the LASD and eventually the Kneiding case was taken over.

        The Khovananth murder was in LAPD jurisdiction but they called in the LASD too, because of the shoeprints.

  8. is I ve been thinking a lot of this joinder “tool ” . But whats behind it ..? It seems that it is used when they assume that one person has , say ,25 crimes which have certain similiarities and there are various connections between them . From the 25 crimes there are 17 with strong evidents and 8 with less strong evidents . And then given the joinder criteria are all fullfilled , they can state that the suspect has done all 25 crimes…!? That is in itself a bit weird I think . …I also think that in Richards case they oversaw that most of the ” evidents ” were no evidents . .And that many ” similiarities ” were usually done in “average capital crimes ” like use of weapons as knifes ,guns etc.is no sign of similiarities as they are so common.in capital crimes. I wonder wether attorneys can object to joinder ..but I think thats in the decicion of the judge….And ..of course when this is sucessful they ” solve ” all 25 cases instead of 17 cases …

    1. The defence did object and filed a motion in September 87. It was denied, but the Higgins count was dropped in December that year as there was no cross admissible evidence and the eyewitness was unreliable. By using ballistics to join the Kneiding incident the Yu/Okazaki cases, they now had eyewitness accounts as well. So if he did Okazaki and Yu, and the ballistics reports say it’s the same weapon as Kneiding, he must’ve done them all. That is the only way they could add in a count where there was no (or very weak) evidence. No witnesses, no shoeprints or fingerprints. Even though the Khovananth incident happened on the same night as the Kneiding one, they did not join them together. Khovananth was joined to the Zazzara case. That the ballistics reports were faulty, conflicted and unreliable never made it into the courtroom.

      I am just using the above as an example, but it should be noted that as early as April 85 Carrillo was trying to link the Zazzara killings to Yu and Okazaki by common ballistics. That failed.
      I am currently putting together a post concerning the ballistics in that particular case as a short addition to the post concerning firearms reports.

    1. Of course. Especially as they didn’t have the weapons to test fire.
      Halpin made sure that only Edward Robinson, the one firearms examiner who said what the prosecution wanted, was allowed to testify. Robinson was the last one to examine the bullets.
      The defence failed by not giving their own expert the evidence he needed to test, and then were denied the opportunity to question the firearms officers who did not agree with Robinson (or each other).

  11. I’m really wondering where they lost that one gun they claimed was a murder weapon and how all of a sudden they lost it?! Makes no sense, if that was indeed the murder weapon and they proved so correctly they would of ofc used it court but then they lost it which makes me think maybe it wasn’t the right murder weapon and they made people trust their words in saying that it is but they don’t have it at the moment?

    1. That particular gun (the Jennings .22 semi-auto) was the one Jesse Perez originally told police was given to him 6 to 9 months before the murder of William Doi occurred. Perez, as we know, later lied and changed his story.

      How they managed to lose it is another mystery.

I understand that part except for the part as to the lost gun but yes that is a mystery for all of us sadly and when they found out Perez lied and changed his story and yet let him go just why?! Why wasn’t he questioned at all or considered a suspect I just don’t get why they did that then his daughter I guess pressured him to say Richard or something then he got a big reward omg this case is so crazy and I Brain right is going crazy haha I’m trying to figure out other possibilities but it’s hard

      2. Maybe because the daughter was connected to law enforcement. She was a marshal. And by that point, they didn’t care about other suspects. They had one goal and that was to catch Richard. Tunnel vision!

        When I was watching Ted Bundt’s case in the line up they had men whom look a lot like Ted as they should with the same hair style and clothes etc…. With Richard they gave him a comb over cuz one victim if I remember right or few victims stayed their attacker had his hair combs back neatly but only had Richard do his hair like that while the rest of the people in the line up messy hair etc… and they allowed this to happen this case is so screwed up, and the amount of directive work you 3 have done seriously wow k could never be as good as you guy thank you so much for all this work.

Yup, they found the perfect fall guy to take the blame and i guess just tried to make up how he could have done those crimes with very little evidence to no evidence etc…. yes I’m talking about you GILY BOY! I can never understand why someone would do that to anyone good or bad, I wish people would stop inviting Gil to their podcast they worship him like Richard with Satan it’s just wrong how they see Gil that way cuz he’s just a money grabber that’s benefited off of a very troubled young man whom needed so much help! Like here in canada I just heard few days ago that a police man ran over a homeless women accidentally or not idk the whole story but still wtf!

      1. I just saw a minute of a new podcast. He’s a disgrace. Expressing gladness he died because it stopped his appeals. I feel bad for Ramirez’s lawyers. None of this stuff came to light. I wish I knew how to disseminate our work further.

Yes me too I feel bad for Ramirez lawers too they worked their best and did a lot for his appeals, idk what you guys think but to me yes he probably did have cancer but still to me I feel like there more to his death than cancer. Take the avias with you and shove it up their ass 😂 but no seriously this is pissing me off you guys have worked hard so hard for this case I’ve never ever seen or heard of anyone even other cops on other cases do this much work I would hunt them down if they did that to you guys.   15. Thanks for explaining the situation with 88 cities and 49 police departments etc. I have to read it once again. But it sclear already that it can become chaotic and difficult in such a system ..and sure they were completely overwhelmed with those many capital crimes and child abductions etc. And Hillside Stranglers ..and Josef de Angelo ..OMG ..And ..the Nightstalker on top ..They had lots of work to do…..to catch all those criminals ! And Josef de Angelo was only caught in 2018. ..this guy I find really shocking ..! He was Not on their radar at the time what a pity . ..Ive just read what Gil Carillo said about no more appeals because Richard s dead. Thats sooo awful to say something like that…!! I really hope you can make some podcasts and some more promotion for the book ! Your book is really sooo good ! And if I hadnt found this blog I would never have read the book .

    1. Yeah, it’s strange, when I looked through the old newspapers that mention DeAngelo’s murders, no one even considers a connection! Crazy because the crimes in the Night Stalker spree were so different.
      There is a documentary on Disney+ called Los Angeles: City of Angels, City of Death. It’s about how the Hillside Strangler, Skid Row Stabber, the Freeway Killer, the Sunset Strip Killer and Rodney Alcala. Who were all concurrent. What a scary place it was back then. Still kind of is… it’s the Wild West out there and they admit there are multiple serial killers active at any one time, yet for Ramirez, it could only possibly be one… convenient.

  17. Hmmm ..What could be done to make the book more popular ? Start a You Tube channel ..? But I m not an expert on this unfortunately . You could just ask some cultural TV channel maybe ..Just offer them this history of you having the idea of writing a different view or approach concerning the Image of the Nightstalker . I mean the idea why you wrote this book ..and the blog and then the research in PlainSite ..etc….I m sure that certain channels are open minded and very interested in such a Story.. TV Channels like Arte of 3 Sat …they are modern and quite risky..You could write a short Exposé or so . And then contact them .You have a book to present them , a new book about an unusual yet interesting subject…Make a connection to True Crime …..Richard Ramirez as a person is maybe also interesting for various people of the Media. Sorry for my bad English , especially at the beginning of this writing , concentration s not at its best tonight…

You could mention the sociological aspects of Richards life in Reagans America in the 80 ties….the Mexican background…whatever ..and then the connection to True Crime ..the whole hype …The Shoko Hara film 2019 was also about R.R. ( and hybristophilia ) you could mention that maybe also….Or …you could make contact with a magazine or so ..Here in Germany there are Magazines like STERN or SPIEGEL …they are always keen on stories which are not Mainstream!

    1. Stern has already had an article on Richard. It’s like all the others. Satanic killer blablabla. I don’t think they would publish anything that contradicts the things they wrote earlier. And I think that’s similar with all the main stream media. Also Lydia Benecke talked about Richard (unfortunately I don’t remember where it was) and it was that typical based on Carlo’s book stuff too. No deep research.

The problem is… If you just think of the appeal documents and all the attachments, or even the trial transcripts with thousands of pages… Main stream media just don’t have the time to do a proper research on the case (a case that happened 40 years ago) and main stream readers are not interested in all the details. It’s pretty nerdy stuff and maybe more interesting for people who are interested in law, like law students or other people interested in legal or forensic aspects of a case. These “nerds” of course do exist and they even are many, but not masses.

      3. That’s very true. When we were in the US we talked with a guy who had read the book (and he liked it) who was living in LA at the time of the trial. It annoys me that in this case, the defence is blocked from asking Jean Wang about Yu’s boyfriend “because she’s only there to state her movements on the day of the murder.” Yet when Jorge Gallegos Calderon is only supposed to be there to say he saw a blue car driving away, he’s allowed to change his whole testimony to a big lover’s quarrel involving Richard Ramirez. And the prosecutor is fine with it cos it suits him. Pffft. Enraging.

    1. Definitely do that. It helps to turn notifications off though, because trolls are gonna troll. Regarding abusive people on the internet, it’s best to drop truth bombs and run and not look back. Don’t bother arguing, it’s futile, just say what you need to and resist the temptation to engage in arguments. Let them chew the facts.

      I used to comment on interviews with Carrillo but the video owners always delete or [deliberately] misunderstand.
      Other good places would be news articles on the case with a live comments section, other people’s blog comment sections etc. On Tumblr, I’ve seen people recommend our book using the ‘ask anonymously’ feature to true crime bloggers.

  25. It really annoys me when people think Richard did ALL the murders. Like, even this one??? Where the witnesses said the killer was short and Asian? Where the witness added to his story in court? Where there was now clearly something going on with the victim’s boyfriend? Where it doesn’t fit the pattern of any other crime? REALLY? Are they slow? I can answer my own question.

Articles in magazines are not so bad ..and you can stay private. Why not make a try …You can argue that this book is a completely deconstruction of the R.R.case ..I mean…they all have this section Newcomer books ( dont find the correct Word right now ) The important thing is that people know about the book and talk about it ! If prople dont know that it exists then nothing can develop.You would just find the right words to introduce it to all the magazinez which possibly were interested. Maybe 50 or more..Haha..Just do it !

    1. That’s what I’ll try. The only way to promote is spreading by ‘word of mouth’ by people recommending it online. There’s no other way. I’m not telling people to fight and argue about him, but to just direct them to it, so they can learn the truth about his court case.

      Articles will take a while to write but definitely worth a try in the coming months. If they don’t work, then I’ll have to sign up for even more blogging sites.

  35. watching more of Ted Bundys case and other I learnt that serial killers don’t attacks people twice or more once they got someone in that day! Like they take a break to find the next victim then attack then the same cycle. In Richard’s case how could he have done one attack then the next in the same day at the same time I forgot the victims names but ya cuz like it doesn’t make Sense! And with Richard friend stating that Richard liked yellow houses doesn’t make sense either cuz he never said or showed any signs he was crazy about yellow or whatever I don’t think he cared about the colour of the house when he was stealing and no one said in his stealing younger years he went to yellow houses, and also Richard stated that his fave color was blue not yellow.

    1. It’s been on the local San Francisco news, papers, everything. Even a guard gave loads of details about being there etc. But it seems so unlikely unless multiple prison guards were involved in the scheme and yet you never hear that anyone got in trouble for it apart from Richard.

Was this supposed to be in St. Quentin ? And ..I was also thinking about him being not handcuffed in some situations ..like in Interviews or when he had those psychic examinatios …But how could he not be handcuffed as a convicted serialkiller ? On the other side , how could he able to snatch a key etc.? Is there any source of Information for this ?

    2. Ordinarily death row prisoners are automatically cuffed on leaving their cells and moved between locations. I always assumed it would be the same for Richard, however as he’s being escorted to that interview with Watkiss he’s not cuffed. He’s not cuffed at all in his two interviews, and not when he was with his lawyers. He probably didn’t need the restraints so they didn’t bother when he was within the prison. I honestly don’t know. As for keys, rectal cavity searches and escape plans, I’ve seen some old news reports, but nothing concrete. Others may have a better idea than I.

I remember her stating that Richard proposed to her and she said no but would have said yes if Richard stopped talking with those other women but then realized that this is all he had and stopped talking and seeing him and she was the one who started writing to him first then others followed. She also stated that she told Richard she wanted to commit a crime and he was like no don’t do it it’s not worth it cuz prison sucks. This is crazy lol
